On one blustery morning, I sat the foil board down near the water’s edge. A windsurfer, who should have known better, sat his sail downwind of my board. The wind picked up my board and sent it ripping through his sail. I felt terrible but he was lovely about it, knowing it was his mistake. The folly left a tiny, barely-noticeable nick in the back of the carbon wing I was able to sand out.
No, you a$$hole, it's your mistake. It's your equipment and you are responsible for it. If he was lovely about it, you owe him a case of beer.

The winger was arrogant to assume the windsurfer was to blame. That said, in this case, neither party saw the situation as hazardous. The winger just left his board sitting out not tied down, while the windsurfer parked his gear right next to it. Consequently,neither party saw any hazard, so it was simply an act of nature that was no one's fault. I don't think that even Morgan and Morgan would take the case for either party.

Randy, you are, imho, being too nice. If this was a rookie starting out, I'd maybe give them a pass. This is a guy doing reviews for a reasonably sized retailer, this isn't his first rodeo. Maybe it did catch him by surprise but his gear did the damage. At the worst, he should have claimed an oopsie but to blame the windsurfer because the windsurfer should have known the wingding was an idiot is victim blaming at the least.
